WSW has a point to prove, that the 'community club' ethos and embracing 'multiculturalism' wasn't just a clever boardroom marketing stunt. This is an opportunity for WSW to show that they may be 2 years old, but their values are rock solid. That they are a club and not a franchise.

ok i will say one more thing santalab to score in the next derby and run up to the cove with an i cant here you celebration :shok: i think i just jizzed 

 

please let us play them in the finals series and let this happen.

 

then at FT, Santa claps the crowd & rudely walks in front of Abbas and rubs it in more, like Evra did to Suarez a year or so ago (im sure someone here has that in a gif :P)

No, it's not 'benefit of the doubt'...it's called 'burden of proof'. The onus of proving any charges in any legal or disciplinary situation with such binding ramifications are not on the defendant, but on the accuser. That's the golden thread of justice that runs through so much of our liberal western legal system, and for all it's faults still is the best way to judge the guilt of anyone in such matters.

Let's face it, both Abbas and Santalab are 'chirpy' characters who enjoy verbally getting in the face of opposition players. It is highly likely that Santalab said something unpleasant but at the end of the day there was no conclusive proof that a) Santa said exactly what Abbas thought he heard, and b) whether it could be considered racial vilification.

If Abbas and Santalab were playing cricket and an incident like this had occurred during The Ashes then the public would have been looking at this matter very differently. I doubt that Michael Clarke would have found himself in front of a tribunal.

 

FFA has found words which keep the integrity of both players intact, and avoids any further damage to the game. We can speculate until the cows come home about what Santa said or meant and what Abbas heard, misheard, or wanted to hear. It is neither here nor there now. Let's move on.

What also needs addressing is the manner in which certain parts of the media leaped on the story like a blowfly on a warm turd...and the worst offender from the get-go was FoxSports. Any responsible director of their coverage should have told their on-field correspondent not to talk to Abbas straight after the game, giving him the chance to go off like a pork chop. Now he had a right to bring his accusations to the attention of the authorities, but giving him a mic and letting him have a spray with no appropriate filter or responsibility was ***** ridiculous. 

 

Such difficult issues need calm and rational examination, not a public brawl egged on by media types just wanting to fatten their ratings or come across as PC heroes. The judgement may not be to everyone's satisfaction but it should draw a close to all the whining and yelping from those outside the situation. Course it probably won't...

Does Santalab have rights to sue Abbas for public defamation?

no, because of this:

1. That Brendon Santalab accepted that Ali Abbas genuinely believed that the offensive word had been used and did not challenge the fact that Ali Abbas believed he had been the subject of racial abuse.

Cool southy. I'm sure you'll do the rounds and tell that to all the appropriate supporters who aren't willing to give Santa the benefit of the doubt.

Is there any way to read more about the hearing and decision? Does a transcript or anything like that exist?

 

Surely if the only evidence Abbas had behind him was what he thought he heard - that was never going anywhere. I'm genuinely curious about why it took so long.

Wasn't this whole thing about someone allegedly racially abusing an Australian named Ali Abbas?  :meep:
