JamCal Posted April 11, 2013 Posted April 11, 2013 I still think the whole... "make it a legal entity" idea that floats around here often, might be the best... We need a taskforce of lawyers haha. (I'm intending to study law next year... I can be an unpaid intern for the company... )

barcenal Posted April 11, 2013 Posted April 11, 2013 The discussion on registering the RBB name and logo as a trademark to further protect them has been happening behind the scenes for a while. People with knowledge in this area (like Boban) I will add to the discussion. We've done our research and have looked at approximately how much it'll cost. However, it'll help having people who are much more experienced with this involved in the process (as BigDukes has been saying). As the creator of the logo, I can certainly say that the logo is an original design of mine. Officially, the only person I've given permission to use the logo has been Sub. Through Benched, I've given a copy of the logo to the club for their use in brochures and for other graphics. However, no one has my permission to make any sort of merchandise with the use of the RBB logo and financially gain from the selling of said merchandise. This includes Sub as well as the club. Regardless of whether they are hard to enforce or not, the copyright laws exist and apply. Any further discussion on this topic I think should be done behind the scenes. At least then we can go into more detail without the prying eyes of the public. All the public needs to know for the time being is what I've mentioned above. If the mods could please lock this topic, I think that'd be most appropriate.

NATO Posted April 11, 2013 Posted April 11, 2013 The logo isn't licensed to be used by the RBB group. Only to specific members. It's also completely original. But you're saying that even with those facts, there's nothing we can actually do to enforce it? Isn't that what fair trading is for? I'm pretty sure what he is saying is that there is something you can do to legally enforce your rights, its just that in the grand scheme of things it'll be too complicated and expensive considering the breach only really involves 1 badge/pin on ebay. Pretty much this. With those facts, it would not be complicated but you still have to prove that those are the facts. Even when you get over the first hurdle, it is not uncommon that when you win legal cases, you still lose. Imagine winning your case and paying all the legal fees and then the person who lost the case has no assets or those assets are in another country. How much was that pin worth again? Sorry to sound like a negative prick, but I'm just being a realist. There are Intellectual Property and Copyright protection authorities who can and will take action on behalf of or assist someone who has a legitimate case, but with IP/Copyright now almost an obsolete concept thanks to the advent of the net and its associated sharing systems, as well as the huge growth in cheap knock-offs from countries like China, India etc...well it's farking hard to get the justice anyone IP holder would want. Look at it this way...if the IOC who have specific legislative protections in place when they award the rights to an Olympic Games can still fall victim to shoddy copies and ambush marketing, well what chance does anyone in an ex officio role with the RBB. Having said that the RBB logo should be registered by the originating artist at least with someone like the ACCC so that there is some kind of IP protection. > Boban and Manfred are like scanners.
